§ 9-9-2. M-2 Manufacturing District.

    Legislative Intent. The purpose of the M-2 Manufacturing District is to provide areas for a variety of industrial uses where major transportation networks provide accessibility. This district is intended to be developed in a manner which will minimize potential adverse influences to adjoining districts through the application of performance standards.

    B.

    Permitted Uses.

    1.

    Permitted uses of land or buildings, as hereinafter listed shall be permitted in the M-2 Manufacturing District under the conditions specified. No building or lot shall be devoted to any use other than a use permitted hereunder with the exception of the following:

    a.

    Uses lawfully established on the effective date of this Code; and

    b.

    Special uses allowed in accordance with the provisions of Section 9-9-2-C.

    2.

    The following uses are permitted in the M-2 Manufacturing District:

    a.

    Offices.

    b.

    Research and development facilities.

    c.

    Contractor and construction supply and shops conducted wholly within an enclosed building, including but not limited to plumbing, HVAC, roofing and electrical.

    d.

    Accessory uses, including, but not limited to, the following:

    (1)

    Antennas and communication towers.

    (2)

    Architectural or landscaping embellishments, pools, fountains and bridges.

    (3)

    Public utility installations and public service uses to include requirements for the furnishing of electricity, gas, oil, telephone and television services.

    (4)

    Storage of building materials (during course of construction only).

    (5)

    Temporary buildings for construction purposes only in accordance with the provisions of Section 9-3-10.

    e.

    The following uses are permitted, however, when the property is adjacent to any residential development, the uses shall only be permitted provided all improvements on the M-2 property, including parking and other structures, are set back a minimum of 100 feet from the nearest residential property line:

    (1)

    Wholesale and distribution facilities.

    (2)

    Wholesale florist or greenhouses.

    (3)

    Printing and publishing facilities.

    (4)

    Manufacturing, production, processing, assembly, fabricating, cleaning, servicing and repairing of materials, goods and products.

    (5)

    Mail order facilities.

    (6)

    Packaging and crating facilities.

    (7)

    Warehouses.

    C.

    Special Uses.

    1.

    Special uses as hereinafter enumerated, may be allowed in the M-2 Manufacturing District, subject to the issuance of special use permits in accordance with the provisions of Section 9-1-18.

    2.

    The following uses may be allowed in the M-2 Manufacturing District:

    a.

    Cartage and express facilities.

    b.

    Building material sales and storage.

    c.

    Self-storage facilities with proprietary residential facility.

    d.

    Rentals, truck and trailer, when operated in conjunction with a self-storage facility.

    e.

    Public utility and public service uses, including municipal.

    f.

    Radio and television facilities.

    g.

    Retail sales accessory to the permitted principal use limited to 15% or less of the total square footage.

    h.

    Motels and hotels on-sites of not less than three acres including subordinate auxiliary uses within or attached to the principal structures.

    i.

    Where the following uses include improvements located less than 100 feet from the nearest residential property line, they may only be allowed as a special use.

    (1)

    Wholesale and distribution facilities.

    (2)

    Wholesale florist or greenhouses.

    (3)

    Printing and publishing facilities.

    (4)

    Manufacturing, production, processing, assembly, fabricating, cleaning, servicing and repairing of materials, goods and products.

    (5)

    Mail order facilities.

    (6)

    Packaging and crating facilities.

    (7)

    Warehouses.

    j.

    Outdoor storage or operations, when accessory to a permitted or allowed special use.

    k.

    All other uses not heretofore cited.

    l.

    Massage establishment.

    D.

    Area Regulations.

    1.

    Minimum Development Area. In order for a parcel to be classified as a M-2 Manufacturing District, the parcel shall contain an area of 25 acres or more under single ownership and/or control.

    2.

    Lot Area. The minimum lot area shall be 40,000 square feet.

    3.

    Lot Width. The minimum lot width shall be 150 feet measured at the building line.

    4.

    Front Yard. The minimum front yard setback shall be 40 feet.

    5.

    Side Yard. The minimum side yard setback shall be 20 feet except where a side yard adjoins a street in which case the required side yard setback shall be 40 feet. Where the side yard of a zoning lot within the M-2 Manufacturing District adjoins the side or rear yard of a zoning lot in a residential or apartment district without an intervening street, such side yard shall be 50 feet.

    6.

    Rear Yard. The minimum rear yard setback shall be 30 feet. Where the rear yard of a zoning lot within the M-2 Manufacturing District adjoins the rear yard of a zoning lot in a residential or apartment district without an intervening street such rear yard shall be 50 feet.

    7.

    Floor Area Ratio. The floor area ratio shall not exceed 1.5.

    E.

    Height Regulations. No portion of any building or structure located in a M-2 Manufacturing District shall exceed 45 feet in height. The maximum height for antennas and communications towers shall be in accordance with Section 9-3-9.

    F.

    Off-Street Parking and Loading Requirements. Adequate provisions shall be made in all cases for off-street parking and off-street loading in accordance with the provisions of Section 9-3-2. In addition, the following conditions shall apply to any lot adjoining a residential or apartment district without an intervening street.

    1.

    No parking shall be permitted within 20 feet of the side and/or rear lot line.

    2.

    No loading dock shall be permitted on the side and/or rear of the building which parallels a residential or apartment district.

    G.

    General Requirements and Performance Standards. This district is subject to the exclusions, conditions, stipulations and requirements set forth in Section 9-3-11. For additional regulations and requirements to the M-2 District, see Article 3 (Section 9-3, General Requirements and Procedures Applicable Within Various Districts). The following shall apply:

    1.

    No doors, operable sash or exhaust facilities other than required by fire code shall be permitted on the side and/or rear of the building facing a lot line abutting a residential or apartment district, unless otherwise approved by the Village Board.
