§ 9-9-1. M-1 Manufacturing District.

    Legislative Intent. The purpose of the M-1 Manufacturing District is to provide areas for low intensity industrial uses and related ancillary uses which specifically serve the M-1 District. This district is intended to be developed in a manner which will minimize potential adverse influences to adjoining districts through the application of performance standards.

    B.

    Permitted Uses.

    1.

    Permitted uses of land or buildings, as hereinafter listed, shall be permitted in the M-1 Manufacturing District under the conditions specified. No building or lot shall be devoted to any use other than a use permitted hereunder with the exception of the following:

    a.

    Uses lawfully established on the effective date of this Code; and

    b.

    Special uses allowed in accordance with the provisions of Section 9-9-1-C.

    2.

    The following uses are permitted in the M-1 Manufacturing District:

    a.

    Offices.

    b.

    Research and development facilities.

    c.

    Contractor and construction supply and shops conducted wholly within an enclosed building, including but not limited to plumbing, HVAC, roofing and electrical.

    d.

    The following uses are permitted, except where adjoining or in any part abutting an existing residential development of one or more dwellings except when separated by a right-of-way of 80 feet or greater:

    (1)

    Light wholesale and distribution facilities.

    (2)

    Wholesale florist or greenhouses.

    (3)

    Printing and publishing facilities.

    (4)

    Light manufacturing, production, processing, assembly, fabricating, cleaning, servicing and repairing of materials, goods or products.

    e.

    Accessory uses, including, but not limited to, the following:

    (1)

    Antennas and communication towers.

    (2)

    Architectural or landscaping embellishments, pools, fountains and bridges.

    (3)

    Public utility installations and public service uses to include requirements for the furnishing of electricity, gas, oil, telephone and television services.

    (4)

    Storage of building materials (during course of construction only).

    (5)

    Temporary buildings for construction purposes only in accordance with the provisions of Section 9-3-10.

    C.

    Special Uses.

    1.

    Special uses as hereinafter enumerated, may be allowed in the M-1 Manufacturing District, subject to the issuance of special use permits in accordance with the provisions of Section 9-1-18.

    2.

    The following special uses may be allowed in the M-1 Manufacturing District:

    a.

    Building material sales and storage.

    b.

    Light self-storage facilities with proprietary residential facility.

    c.

    Rentals, truck and trailer, when operated in conjunction with a light self-storage facility.

    d.

    Radio and television facilities.

    e.

    Retail sales accessory to the permitted principal use limited to 15 percent or less of the total square footage.

    f.

    Motels and hotels on sites of not less than three acres including subordinate auxiliary uses within or attached to the principal structures.

    g.

    Public utility and public service uses, including municipal.

    h.

    The following uses may be allowed as a special use where adjoining or in any part abutting an existing residential development of one or more dwellings:

    (1)

    Printing and publishing facilities.

    (2)

    Light manufacturing, production, processing, assembly, fabricating, cleaning, servicing and repairing of materials, goods and products.

    (3)

    Light wholesale and distribution facilities.

    (4)

    Wholesale florist or greenhouses.

    i.

    Outdoor storage or operations, when accessory to a permitted or allowed special use.

    j.

    Massage establishment.

    k.

    Nonprofit food pantries that may include related outreach activities such as accessory training and educational resources. Food pantries shall not include on-site food service or preparation, thrift/resale shops, clothing, furniture or similar merchandise, exterior donation boxes, employment placement offices, or similar uses.

    l.

    All other uses not heretofore cited.

    D.

    Area Regulations.

    1.

    Minimum Development Area . In order for a parcel to be classified as an M-1 Manufacturing District, the parcel shall contain an area of ten acres or more under single ownership and/or control.

    2.

    Lot Area. The minimum lot area shall be 20,000 square feet.

    3.

    Lot Width. The minimum lot width shall be 70 feet measured at the building line.

    4.

    Front Yard. The minimum front yard setback shall be 30 feet.

    5.

    Side Yard. The minimum side yard setback shall be ten feet except where a side yard adjoins a street in which case the required side yard setback shall be 30 feet. Where the side yard of a zoning lot within the M-1 Manufacturing District adjoins the side or rear yard of a zoning lot in a residential or apartment district without an intervening street, such side yard shall be 50 feet.

    6.

    Rear Yard. The minimum rear yard setback shall be 20 feet. Where the rear yard of a zoning lot within the M-1 Manufacturing District adjoins the rear yard of a zoning lot in a residential or apartment district without an intervening street, such rear yard shall be 50 feet.

    7.

    Floor Area Ratio. The floor area ratio shall not exceed 1.5.

    E.

    Height Regulations. No portion of any building or structure located in an M-l Manufacturing District shall exceed 45 feet in height. The maximum height for antennas and communications towers shall be in accordance with Section 9-3-9.

    F.

    Off-Street Parking and Loading Requirements. Adequate provision shall be made in all cases for off-street parking and off-street loading in accordance with the provisions of Section 9-3-2. In addition, the following conditions shall apply to any lot abutting a residentially zoned area:

    1.

    No parking shall be permitted within 20 feet of the side and/or rear lot line abutting a residential or apartment district.

    2.

    No loading dock shall be permitted on the side and/or rear of the building which parallels a lot line abutting a residential or apartment district.

    G.

    General Requirements and Performance Standards. This district is subject to the exclusions, conditions, stipulations, and requirements set forth in Section 9-3-11. For additional regulations and requirements pertaining to the M-1 District, see Article 3 (Section 9-3, General Requirements and Procedures Applicable Within Various Districts). The following shall apply:

    1.

    No doors, operable sash or exhaust facilities other than required by fire code shall be permitted on the side and/or rear of the building facing a lot line abutting a residential or apartment district, unless otherwise approved by the Village Board.
