§ 7-2-2. Sale of tobacco product or electronic smoking devices to persons under 21 years of age prohibited.

  • A.

    Prohibited Sales, Delivery or Possession.

    1.

    It shall be unlawful for any person under 21 years of age to buy any Tobacco Product or Electronic Smoking Device as defined in Section 8-7-15 of the Municipal Code.

    2.

    It shall be unlawful for any person under 21 years of age to possess any Tobacco Product or Electronic Smoking Device.

    3.

    It shall be unlawful for any person to sell, buy for or furnish any Tobacco Product or Electronic Smoking Device to any person under 21 years of age.

    B.

    Signs. Signs informing the public of the age restrictions provided for herein shall be posted by every Tobacco Product or Electronic Smoking Device licensee at or near every display which offers Tobacco Products or Electronic Smoking Devices for sale. The text of such signs shall be in red letters on a white background, said letters to be at least one-half (½) inch high. Each such sign shall be plainly visible and shall state:

    "THE SALE OF TOBACCO PRODUCTS AND ELECTRONIC SMOKING DEVICES TO PERSONS UNDER TWENTY-ONE YEARS OF AGE IS PROHIBITED BY LAW"

    C.

    License Revocation. The business license of any Tobacco Product or Electronic Smoking Device dealer issued under Section 8-7-15 of this Municipal Code shall be revoked upon a third conviction of Section 7-2-2-A-3 in any 12-month period.
