§ 8-3-5. Restriction on licenses.

  • No license shall be issued to:

    A.

    A person who is not a resident of the Village or does not reside within 20 miles of the Village.

    B.

    A person who is not a citizen of the United States;

    C.

    A person who has been convicted of a felony under any Federal or State law if the Commission determines, after investigation, that such person has not been sufficiently rehabilitated to warrant the public trust;

    D.

    A person who has been convicted of being the keeper of or keeping a house of prostitution;

    E.

    A person who has been convicted of pandering or other crime or misdemeanor opposed to public decency and morality;

    F.

    A person whose license under this Article has been revoked for cause;

    G.

    A person who at the time of application for renewal of any license issued hereunder would not be eligible for such license if he were not eligible under a prior application;

    H.

    A partnership, unless all the members of such partnership shall be qualified to obtain a license;

    I.

    A corporation or limited liability company, if any member, officer, manager or director thereof, or any stockholder or stockholders owning directly or beneficially in the aggregate more than five percent of the stock of such corporation, would not be eligible to receive a license hereunder for any reason other than citizenship and residence within the Village or within 20 miles of the Village;

    J.

    A corporation or limited liability company unless it is incorporated or organized in Illinois, or unless it is a foreign corporation or foreign limited liability company which is qualified under the Business Corporation Act or the Limited Liability Company Act to transact business in Illinois;

    K.

    A person whose place of business is conducted by a manager or agent unless said manager or agent possesses the same qualifications required of the licensee;

    L.

    A person who has been convicted of a violation of any Federal or State law concerning the manufacture, possession or sale of alcoholic liquor, who shall have forfeited his bond to appear in court to answer charges for any such violation;

    M.

    A person who does not own the premises for which a license is sought, or does not have a lease thereon for the full period for which the license is issued;

    N.

    Any elected public official, Village of Hoffman Estates employee, or member of any Hoffman Estates Board or Commission, and no such official shall be interested in any way, either directly or indirectly;

    O.

    Any applicant who fails to obtain a State liquor license shall not be able to operate in the Village;

    P.

    A person who is not a beneficial owner of the business to be operated by the licensee;

    Q.

    A person who has been convicted of a gambling offense as proscribed by any of the sections or subsections of Chapter 7, Article 7 (Gambling and Related Offenses) of the Municipal Code of the Village of Hoffman Estates;

    R.

    A person to whom a Federal gaming device stamp or a Federal wagering stamp has been issued by the Federal Government for the current tax period;

    S.

    A partnership to which a Federal Gaming device stamp or a Federal Wagering stamp has been issued by the Federal Government for the current tax period, or if any of the partners have been issued a Federal wagering stamp by the Federal Government for the current tax period;

    T.

    A corporation or limited liability company, if any member, officer, manager or director thereof, or any stockholder owning in the aggregate more than five percent of the stock of such corporation has been issued a Federal gaming stamp or a Federal wagering stamp for the current tax period;

    U.

    Any premises for which a Federal gaming device stamp or a Federal wagering stamp has been issued by the Federal Government for the current tax period;

    V.

    A club which in its membership policies and practices or in its service to guests, discriminates on the basis of race, religion, national origin or sex;

    W.

    A corporation or limited liability company, unless the designated person operating as manager of the premises as required by Section 8-3-4 is a resident of the Village or resides within 20 miles of the Village.
