§ 7-8-8. Buildings, trailers, excavation and commercial operations.

    Buildings in Unsanitary Condition.

    1.

    It is hereby declared a nuisance for an owner or tenant to maintain any apartment or residence in an unsanitary or dangerous condition which in any way endangers the health, safety or welfare of any person living therein.

    2.

    A person creates the offense of unlawful housing management when they construct or maintain any apartment building or residential home in an unsafe or dangerous condition by neglecting the inside or outside physical condition, including swimming pools, recreational facilities and garages.

    3.

    Vacant units or buildings in progress when exterior is complete must be kept in good condition. Broken windows must be replaced or covered, grounds must be maintained and free of debris, premises secured from intruders, and the inside and outside maintained in such a condition so as not to attract rodents or breed mosquitos.

    4.

    It shall be the duty of the Public Health Officer to serve notice in writing upon such owner, occupant, agent or person in possession or control of any residence, building or premises in or upon which any nuisance may be found or who may be the owner or cause of any such nuisance, requiring the owner to abate the same in such manner as the Public Health Officer shall prescribe within a reasonable time. It shall not be necessary in any case for the Public Health Officer to specify the manner in which any nuisance shall be abated. It shall be unlawful for any person so notified to neglect or refuse to comply with the requirements of such order or failing to abate such nuisance or offense within the time specified.

    B.

    House Trailer or Camping Trailer. It shall be unlawful to allow or permit any house trailer, camping trailer or van to be used for human habitation.

    C.

    Building Operations. It shall be unlawful to allow or permit any building operations between the hours of 7:00 p.m. and 7:00 a.m. on weekdays and between 6:00 p.m. and 8:00 a.m. on Saturdays and Sundays within 500 yards of any residents, and between 10:00 p.m. and 7:00 a.m. on weekdays and between 10:00 p.m. and 8:00 a.m. on Saturdays and Sundays otherwise; to make any loud noises, to operate any power shovels or hammers, bulldozers or other apparatus, the use of which is attended by loud or unusual noises, in any area primarily zoned and occupied as residential.

    D.

    Excavations. No person shall leave open any well, retention ponds, excavation or other like hole, without securing or protecting or posting a warning sign in clear view, or properly illuminating the same to prevent an injury or danger to any person.

    E.

    Refuse Hauler Operations.

    1.

    The collection of refuse, recyclables and other solid waste at any commercial establishment in a non-residential zoning district contiguous to any portion of a residential zoning district within 200 feet of any place of regular residence shall be limited to the hours of 7:00 a.m. to 6:00 p.m., Monday through Saturday, inclusive.

    2.

    The collection of refuse, recyclables and other solid waste in a residential zoning district shall be limited to the hours of 7:00 a.m. to 6:00 p.m., Monday through Saturday, inclusive.

    F.

    It shall be unlawful to permit any motor vehicle or trailer to be parked between the hours of 1:00 a.m. and 6:00 a.m. upon any property in a non-residential zoning district if such property is vacant or is not a licensed use or building except for motor vehicles or trailers necessary for construction or work on or upon the commercial establishment.
