§ 7-5-11. Unnecessary repetitive driving.

    Definitions.

    1.

    Designated area is herein defined as: 1) the east-west road area with the Barrington Square Shopping Center from the easterly point of the eastern-most building west to the westerly point of the western-most building; and 2) the north-south road area from the westerly Higgins Road entrance to the Barrington Square Shopping Center north to the east-west road at the center of the mall; and 3) the east-west road area from Governor's Lane entrance to the Barrington Square Shopping Center west to its western terminus at the west edge of the Barrington Square Shopping Center; and 4) the north-south road area from the easterly Higgins Road entrance to the Barrington Square Shopping Center north to the east-west road at the easterly point of the eastern-most building; and 5) the north-south road area from the Hassell Road entrance to the Barrington Square Shopping Center south to the westerly point of the western-most building. These designated areas shall be clearly marked with permanent fixed signs advising the public that the area is subject to regulation under this section.

    Private property is an area of public access to privately owned property where an enforcement agreement is in effect by and between the owner of the property and the Village under 65 ILCS 5/1-1-7, 625 ILCS 5/11-209, 625 ILCS 5/11-209.01 or the Home Rule Powers of the Village.

    3.

    Traffic control point means a clearly identified reference point within a designated area upon a public street or upon private property as determined and marked time to time by the Hoffman Estates Police Department.

    Definition as Used in the section Unnecessary repetitive driving is defined as driving a motor vehicle, upon a public street or upon private property past a traffic control point as designated by the Hoffman Estates Police Department more than twice in any one hour period between the hours of 7:00 p.m. and 2:00 a.m.

    B.

    Offense. No person shall engage in unnecessary repetitive driving as defined in Sub-Section A.

    C.

    Exclusions. This section shall not apply to any municipal, emergency, police, fire, ambulance or other governmental vehicle when same is being operated in an official capacity. In addition, this Article shall not apply to any duly licensed public transportation vehicle nor to any vehicle utilized for business and/or commercial purposes.
